A.1. USER DATA COLLECTION AND PROCESSING
Within the scope of the website hosted at www.bodegaslan.com (“Website”) including the provision of information about their services and communications made available, Bodegas LAN, S.A., with the corporate taxpayer number A26011916, with its registered office at Paraje de Buicio s/n (“Bodegas LAN”), may require the User to provide personal data, that means any information that allows Bodegas LAN to identified and contact the User (“Personal Data”).
The Users consent to the collecting and processing of their Personal Data by Bodegas LAN, as the Responsible for the Processing, with the following purposes depending on the section in which the User provides their Personal Data:
- Marketing the products and providing services;
- Manage the affiliation and relationship of Club Lanciano;
- Organize visits to the Winery;
- Manage the subscription to the Newsletter;
- Request contact through the form available on the Website.
All this in the terms of this Privacy Policy and in accordance with the current regulations on the protection of personal data. The treatment is based on the consent granted by accepting the Privacy Policy. This consent may be revoked at any time by sending a written communication to the Privacy Manager, to the following email address: privacidad@bodegaslan.com.
The owner of the website www.bodegaslan.com is Bodegas LAN, telephone 941450950, fax 941450567 and email address: info@bodegaslan.com. Bodegas LAN is registered in the Mercantile Registry of La Rioja, in Volume 322, Folio 106, Page LO-2855.
The collected and processed Personal Data consist of information regarding the name, surname, email address, telephone number and other personal information provided by the User.
Bodegas LAN, when collecting Personal Data directly, provides the data subject with detailed information about the nature of the data collected and about the purpose and processing that will be carried out in relation to the Personal Data, through the consultation of the Privacy Policy made available on the Website.
Bodegas LAN also collects and treats information about its hardware and software, as well as information about the pages visited by the User within the Website. This information may include: the type of browser, the domain name, access times and hyperlinks through which the User accessed the Website (hereinafter, “Information of Use”). We use this information to improve the quality of your visit to our Website.
Usability Information and Personal Data are designated in this Privacy Policy by “User Data”.
A.2. PROCESSORS
As part of the processing of User Data, Bodegas LAN uses or may have recourse to third parties, subcontracted by it, for, on behalf of Bodegas LAN, and in accordance with the instructions given by Bodegas LAN, in accordance with the law and this Privacy Policy.
These Processors may not transmit the User Data to other entities without Bodegas LAN have given prior written authorization to do so, and are also prevented from contracting other entities without Bodegas LAN prior authorization.
Bodegas LAN undertakes to only subcontract to entities that offer the maximum security in the implementation of the appropriate technical and organizational measures, in order to guarantee the defense of the User’s rights. All entities sub-contracted by Bodegas LAN shall be bound by Bodegas LAN by the means of a written agreement which covers: the object and duration of the processing, the nature and purpose of the processing, the type of Personal Data, the categories of data subjects and the rights and obligations of the parties.
A.3. DATA COLLECTION CHANNELS
Bodegas LAN may collect data directly (i.e., directly from the User) or indirectly (i.e. via partner entities or third parties). Such collection may be done through the following channels:
- Direct collection: in person, by telephone, via e-mail and through the Website;
- Indirect collection: through partners or group companies and official entities.
GENERAL PRINCIPLES RELATING TO PROCESSING OF USER DATA
In terms of the principles relating to processing of Personal Data, Bodegas LAN undertakes to ensure that the User Data processed are:
- Subject to a lawfully, fairly and in a transparent manner in relation to the User;
- Collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
- Adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
- Accurate and, where necessary, kept up to date. Every reasonable step must be taken to ensure that Personal Data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;
- Kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the Personal Data are processed;
- Processed in a manner that ensures appropriate security of the Personal Data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures.
Data processing carried out by Bodegas LAN is lawful only if and to the extent that at least one of following applies:
- The User has given consent to the processing of his or her personal data for one or more specific purposes;
- The processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
- The processing is necessary for compliance with a legal obligation to which Bodegas LAN is subject;
- The processing is necessary in order to protect the vital interests of the User or of another natural person;
- The processing is necessary for the purposes of the legitimate interests pursued by Bodegas LAN or by a third party (except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of Personal Data).
Bodegas LAN undertakes to ensure that User Data is only processed under the conditions cited above and respecting the principles mentioned above.
When processing of the User Data is performed by Bodegas LAN based on the User’s consent, the User has the right to withdraw his/her consent at any time. Such withdrawal of the consent, does not compromise the lawfulness of processing carried out by Bodegas LAN, based on the consent previously given by the User.
The period of time, which the data is filed and stored, varies according to the purpose for which the information is being processed.
Effectively, there are legal requirements that require the data to be preserved for a minimum period of time. Thus, and where there is no specific legal obligation, the data will be stored and kept only for the minimum period necessary for the purposes that lead to their collection or subsequent processing, which at the end of the period will be deleted.
B.1. USE AND PURPOSES OF USER DATA PROCESSING
The Users consent to the collecting and processing of their Personal Data by Bodegas LAN, as the Responsible for the Processing, with the following purposes depending on the section in which the User provides their Personal Data:
- Marketing the products and providing services;
- Manage the affiliation and relationship of Club Lanciano;
- Organize visits to the Winery;
- Manage the subscription to the Newsletter;
- Request contact through the form available on the Website.
The User Data collected by Bodegas LAN is not shared with third parties without the User’s consent, except in the situations mentioned in the following paragraph. However, in the event of the User contracting services with Bodegas LAN that are provided by other entities responsible for the processing of Personal Data, User Data may be consulted or accessed by such entities, to the extent that it is necessary for the provision of such services.
Bodegas LAN, in the applicable legal terms, may transmit or communicate the User Data to other entities in the event of such transmission or communication are necessary for the implementation of the contract established between the User and Bodegas LAN or in order to take steps to entering into a contract procedures at the request of the User, if necessary for the fulfilment of a legal obligation to which Bodegas LAN is subject or, if it is necessary, to obtain them in the legitimate interests of Bodegas LAN or of a third party.
B.2. TECHNICAL, ORGANIZATIONAL AND SECURITY MEASURES IMPLEMENTED
In order to guarantee the security of the User Data and the maximum confidentiality, Bodegas LAN processes the information provided in an absolutely confidential manner, in accordance with our internal security and confidentiality policies and procedures, which are updated periodically as required, as well as the terms and conditions legally set out.
Bases in the nature, scope, context and purpose of data processing, as well as the risks arising from the processing of the rights and freedoms of the User, Bodegas LAN undertakes to apply, when defining the method and timing of handling the data, the appropriate technical and organizational measures necessary for the protection of User Data and compliance with legal requirements.
It also undertakes to ensure that, by default, only data that are necessary for each specific purpose are processed and that such data are not made available without human intervention to an indeterminate number of people.
Bodegas LAN adopts the following general security measures:
- Regular audits to identify the effectiveness of the technical and organizational measures implemented;
- Awareness and training of personnel involved in data processing operations;
- The pseudonymisation and encryption of Personal Data;
- Mechanisms capable of ensuring the to ensure the ongoing confidentiality, integrity, availability and resilience of processing systems and services;
- Mechanisms capable to ensure the ability to restore the availability and access to Personal Data in a timely manner in the event of a physical or technical incident.
B.3. TRANSFERS OF PERSONAL DATA TO THIRD COUNTRIES (OUTSIDE THE EUROPEAN UNION)
In certain types of processes, the Personal Data collected and used by Bodegas LAN may be available to third parties, which may imply their transfer outside the European Union. If such a transfer takes place, Bodegas LAN undertakes to ensure that the transfer complies with the applicable legal provisions, regarding the country’s adequacy decision with respect to data protection and the requirements applicable to such transfers.
B.4. COOKIES

USER RIGHTS (DATA SUBJECTS)
C.1 PROCEDURES FOR THE EXERCISING OF USERS RIGHTS
Bodegas LAN respects individual privacy and guarantees that the Personal Data voluntarily provided by the Users are treated with confidentiality, exclusively for the purposes that sustain their availability, and will be maintained until their consent is revoked or, where appropriate, for the term established in the law. The Users may exercise their rights of access, rectification, erasure, restriction of processing, to object and to data portability by written communication to the Privacy Manager, to the following email address: privacidad@bodegaslan.com.
Likewise, Users have the right to seek the protection of the Spanish Agency for Data Protection through its website www.agpd.es. The Personal Data collected and processed consist of information about the name, email, address and other personal information provided by the Users.
Bodegas LAN will respond in writing (and by email) to the User’s request within a maximum period of one month from receipt of the request, except in particular complex cases, for which this period could be extended up to two months.
C.2 DATA BREACH
When the personal data breach is likely to result in a high risk to the rights and freedoms of natural persons, Bodegas LAN shall communicate the Personal Data breach to the User without undue delay.
In legal terms, the communication to the User shall not be required if any of the following conditions are met:
- Bodegas LAN has implemented appropriate technical and organizational protection measures, and those measures were applied to the Personal Data affected by the personal data breach, in particular those that render the Personal Data unintelligible to any person who is not authorized to access it, such as encryption;
- Bodegas LAN has taken subsequent measures which ensure that the high risk to the rights and freedoms of data subjects referred to in paragraph above is no longer likely to materialize;
- It would involve disproportionate effort. In such a case, there shall instead be a public communication or similar measure whereby the User are informed in an equally effective manner.
FINAL PART
D.1 CHANGES TO PRIVACY POLICY
Bodegas LAN reserves the right to make changes to this Privacy Policy at any time. In the case of adjustment to the Privacy Policy, the date of the most recent change will be available at the top of this page. If the change is substantial, a notice will be placed on the Website.
D.2 APPLICABLE LAW AND LEGAL JURISDICTION
The Privacy Policy, as well as the collection, processing or transmission of User Data are all governed by the provisions of EU Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016, and by the laws and regulations applicable in Spain.
Any litigation arising from the validity, interpretation or implementation of the Privacy Policy, or related to the collection, processing or transmission of User Data, must be submitted exclusively to the jurisdiction of the courts of Logroño (Spain), without prejudice to mandatory legal rules.
